STANDARD TERMS & CONDITIONS (QUEENSLAND)

Welcome to The Skin Element. These Terms & Conditions govern all bookings, consultations, treatments, purchases, and interactions with our clinic and website.

1. Appointments, Cancellations, and No-Shows

Booking Confirmation: All appointments must be confirmed via SMS, email, or online booking.
Late Arrivals: Arriving more than 10 minutes late may result in rescheduling or reduced treatment time.
Cancellations:
- 24 hours’ notice is required for cancellations or rescheduling.
- Cancellations made with less than 24 hours’ notice may incur a cancellation fee of $50.
No-Shows:
- Failure to attend without notice will result in a no-show fee of 100% of the booked service.
- Multiple no-shows may lead to suspension of booking privileges.

2. Refunds and Returns

In accordance with the Australian Consumer Law (ACL):

We do not offer refunds for change of mind, unused services, or dissatisfaction with the outcome unless a consumer guarantee under the ACL has been breached.
If there is a major fault with a product or service, you may be entitled to a replacement, re-service, or refund.
Refunds are not provided where the outcome of a treatment does not meet your expectations, provided the service was rendered with due care and skill.

3. Medical and Cosmetic Services Disclaimer

Our treatments are cosmetic and do not constitute medical advice, diagnosis, or therapy unless expressly performed by a qualified medical practitioner.
Individual results may vary. You must disclose any relevant medical conditions, medications, or prior treatments during your consultation.

4. Collection and Use of Personal Data

Your privacy matters.

We collect and manage your data in accordance with the Privacy Act 1988 (Cth) and the Australian Privacy Principles (APPs).

Types of information collected:
- Contact details, health history, treatment notes, images (with consent), payment information.
Purpose of collection:
- Delivering cosmetic services, maintaining health records, appointment management, and regulatory compliance.
Storage and security:
- Your data is securely stored in accordance with health data retention obligations under the Health Records and Information Privacy Act 2002 (NSW) (if applicable) and state health privacy principles.
Use of images:
- Before and after photos will only be used for marketing or educational purposes with your express written consent.

5. Online Bookings and Website Use

The Skin Element website and booking system are provided “as is.”
We do not guarantee uninterrupted access or availability of the booking system.
By using our site, you agree not to engage in any activity that could damage or impair our systems.

6. Legal and Regulatory Compliance

The Skin Element operates in compliance with:

Health Practitioner Regulation National Law (Qld)
Australian Consumer Law under Schedule 2 of the Competition and Consumer Act 2010 (Cth)
Therapeutic Goods Act 1989 (Cth) for any applicable cosmetic injectables
Privacy Act 1988 (Cth) for handling health information

7. Consent and Acknowledgements

All clients must complete a consultation and consent form before undergoing treatment.
You acknowledge that cosmetic treatments may carry risks and outcomes may vary.
You agree to follow post-treatment care instructions as provided by our practitioners.
